These Terms of Use (“Terms”) govern your access to and use of our website, applications, products, and services (collectively, the “Platform”).

By accessing or using myNDA, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please refrain from using the Platform.

1. Eligibility

You must be at least 18 years old to use this Platform. By using myNDA, you confirm that you have the legal capacity to enter into a binding agreement, or that you are acting with the authority of a registered business entity.

3. User Responsibilities

By using myNDA, you agree to:

• Provide accurate and complete registration information

• Use the Platform lawfully and not for fraudulent, harmful, or abusive purposes

• Respect the intellectual property rights of myNDA and third parties

You are solely responsible for your activity on the Platform, including uploaded documents and information shared through the system.

4. Data Collection & PDPA Compliance

We collect, use, and store your personal data in accordance with Malaysia’s Personal Data Protection Act 2010 (PDPA). By using myNDA, you consent to:

• The processing of your personal data as described in our Privacy Policy

5. Intellectual Property

All content on the Platform—including but not limited to templates, flowcharts, trademarks, software code, and documentation—is the intellectual property of myNDA or its licensors. You may not copy, distribute, modify, or reverse-engineer any part of the Platform without prior written permission.

You retain ownership of documents you generate, upload, or store on the Platform. However, you grant us a non-exclusive, limited license to process such content solely to provide the service to you.

6. Paid Plans and Subscriptions

myNDA offers multiple subscription tiers with varying features and pricing. All payments made are non-refundable unless stated otherwise in a specific agreement.

We reserve the right to:

• Modify pricing with prior notice

• Suspend accounts for non-payment or misuse

• Apply usage limits (e.g. tokens, storage) per your selected tier
  
  

7. Disclaimers

• myNDA is not a law firm and does not provide legal advice.

• While we partner with legal experts to vet our templates, all documents are for general use and may require independent legal review.

• The Platform is provided “as is” without warranties of any kind. We do not guarantee uninterrupted access or error-free performance.
  
  

8. Limitation of Liability

To the maximum extent permitted by law, myNDA shall not be liable for:

• Any indirect, incidental, special, or consequential damages

• Loss of data, revenue, or profits

• Legal disputes arising from your use of templates or contracts
  
  

You agree that our total liability shall not exceed the amount paid by you (if any) for the use of the Platform in the last 6 months.

9. Termination

We may suspend or terminate your account at our discretion if:

• You violate these Terms

• You misuse or abuse the Platform

Upon termination, your access to the Platform will cease, but your legal obligations and our data handling responsibilities will continue as outlined in the Privacy Policy.

10. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Malaysia. Any disputes shall be resolved in the courts of Malaysia.
